RE: Hale O Kaula Church, et al. v. The Maui Planning Commission, et al.
Civ. No. 01-000615 SPK KSC; U.S. District Court - District of Hawaii
Dear Friends in Christ:
The information that I am presenting to you in this letter may have already been provided by your attorney in the referenced case, Charles H. Hurd. Since I do not know this for a fact, however, I thought I should give you a bit of background in this letter.
I am currently involved in a dispute in which the Claimant, Mary Lou Woo, and her attorney, Steven Guttman, of Kessner, Duca, Umebayashi, Bain & Matsunaga, have issued a Demand for Arbitration and are attempting to have the American Arbitration Association (AAA) appoint an arbitrator which may have multiple conflicts of interest due to her position on the Maui Planning Commission. When I first learned of the lawsuit brought by the U.S. Attorney General in the Hale O Kaula case, I reported my concerns to their office. A copy of my initial letter to them dated August 9, 2003, is enclosed for your information.
As I did not receive a response to this letter from the U.S. Attorney’s office, I subsequently wrote to Charles H. Hurd to inform him of the situation and to see if he might wish to represent me in my arbitration case. Since I had not received a response from him – until yesterday – I also began sending copies of my correspondence to the AAA to Roman Storzer, Esq., of The Becket Fund for Religious Liberty.
The reason that I am now contacting you directly, instead of going through your attorney, is because Mr. Hurd, in his letter of October 17th, asked that I stop sending him materials. For his explanation for this request, please see the enclosed copy of his letter. I am also enclosing a copy of my initial letter to Mr. Hurd dated October 2nd for further details. As the volume of past correspondence is too great for me to provide copies of everything, if you have not been previously informed of this matter and you wish to review some of my past letters, you can find them on the internet at www.the-catbird-seat.net/ArbitrateThis.htm. (now at www.kycbs.net/ArbitrateThis.htm
In accordance with Mr. Hurd’s request, I will not send him any further correspondence, but I will, instead, send future copies of my letters directly to you – just in case you may be interested in seeing how this situation develops. If you wish to be taken off the list of parties receiving copies, please let me know and I will do so immediately – no explanation required.
If you have any questions at all regarding this matter, please feel free to contact me either by phone or fax at the number which appears in the letterhead. Or, if you prefer to contact me by e-mail, you may do so at ----------
I pray for your congregation’s success in your battle for religious freedom.
Sincerely yours,
Bobby N. Harmon
