Dear Mr. Tsukazaki:

This is to advise you that I have just received your notice of Hearing entitled: “Party In Interest Kamehameha Schools’ Joinder In Plaintiff Mary Loo Woo’s Motion For Summary Judgment On Plaintiff’s Application for Confirmation of Arbitration Award and For Entry of Judgment Against Bobby N. Harmon, Filed January 13, 2005 ...”

This Notice was sent by First Class Mail from Honolulu, Hawaii, on June 1, 2005. It was not delivered to my mail box until Saturday, June 4, 2005; however, I did not pick up this mail until Sunday, June 5, 2005. Given this short notice, and since I do not have an attorney representing me, there is no possible way that I could prepare and submit an Answer, and to travel to Honolulu to be physically present for the Hearing had I desired to do so. Also, this Hearing has been scheduled before Judge David A. Ezra, who is one of the judges named in my Complaint of Judicial Misconduct No. 05-89053 to the United States Court of Appeals, Ninth District.

As I have not had time to prepare a formal Answer and mail it to the Court in time for today’s hearing, I am sending this response to you by facsimile to request that you have the Hearing date rescheduled in order to give me a reasonable period of time to prepare my response and send it to the Court by First Class Mail. I also would ask that, if you are going to make ANY filings in this case prior to the Judicial Council’s response to my Judicial Misconduct Complaint, you would ask that a different judge be assigned to hear your motion.

There are a number of additional reasons why I believe you should request postponement of today’s Hearing. These include the fact that I have never been provided a COMPLETE, SIGNED COPY of the Settlement and Release Agreement, despite numerous requests to Trustee Mary Lou Woo for such a complete copy. Also, I have not received a copy of the “side letter” agreement described in Steven Guttman’s letter to my attorney Arnold Phillips dated June 2, 2000 (Claimant’s Exhibit 23 in Arbitration Case No. 74 166 00491 03 JUSC). A copy of this letter is enclosed for your reference, and can be found at the following Internet address:

As I believe I am entitled to copies of both of these material documents sans subpoena, I am hereby requesting that you immediately provide me copies of this “side letter” and a complete, signed copy of the Settlement and Release Agreement.
