Dear Ms. Catterson:


Thank you for your letter dated May 25, 2005, regarding the referenced Complaint.


This is to advise the Judicial Council of what I consider to be another act of judicial misconduct in this case. On this Saturday, I received a legal notice from Matt A. Tsukazaki, entitled: “Party In Interest Kamehameha Schools’ Joinder In Plaintiff Mary Loo Woo’s Motion For Summary Judgment On Plaintiff’s Application for Confirmation of Arbitration Award and For Entry of Judgment Against Bobby N. Harmon, Filed January 13, 2005, Filed April 13, 2005.” A copy of this Notice is enclosed for your reference.


My complaints regarding this Notice are numerous, but I will mention only two. First, there was not sufficient notice to give adequate time for me to prepare for, or to attend, this Hearing which is scheduled for today, Monday, June 6, 2005, at 9:45 a.m., before Hon. David A. Ezra. This Notice was sent by First Class Mail from Honolulu, Hawaii, on June 1, 2005. It was not delivered to my mail box until Saturday, June 4, 2005; however, I did not pick up my mail until Sunday, June 5, 2005. Given this short notice, and since I do not have an attorney representing me, there is no possible way that I could prepare and submit an Answer, and to travel to Honolulu to be physically present for the Hearing.


Second, the Hearing is before Judge David A. Ezra, who is one of the judges named in my Complaint.


As a layperson, I am not aware of the time requirements for giving Notice of Hearing in such cases, but I do believe that, given these circumstances, a Defendant should be given sufficient time to enable him to prepare for, and to attend, any court proceedings. Also, I do not understand the urgent need for Kamehameha Schools to rush this particular Hearing before the Judiciary Council has had the opportunity to respond to my complaint. Most importantly, it is beyond my understanding why Judge David Ezra would not recuse himself - from this particular Hearing, at least - until the Judiciary Council has had time to issue their opinion in this case.
