Settlement Agreement signature pages, and its Exhibit 5 which was omitted from Mary Lou Woo’s Demand for Arbitration. Exhibit 5, which is the Order Granting Trustee’s Motion To Approve Settlement, was filed on March 24, 2000. However, the Agreement was NOT SIGNED BY ALL PARTIES IN INTEREST at the time it was filed, and at the time of its approval by Judge Lloyd King. (Note, particularly, that the Agreement was not signed by Federal Insurance Co. until 06/29/00, and by Marsh & McLennan Companies until 09/11/00.) Importantly, the Agreement was NOT SIGNED BY ALL DEFENDANTS in the RICO lawsuit, namely, HENRY PETERS, RICHARD WONG, GERARD JERVIS, LOKELANI LINDSEY, and OSWALD STENDER, which constituted an incomplete and fraudulent filing by Trustee MARY LOU WOO and her attorney, STEVEN GUTTMAN. Consequently, this was an INVALID CONTRACT which is unenforceable under contract law. Also, Judge Lloyd King erred in approving the Settlement Agreement which had not been signed by ALL PARTIES to the case. Furthermore, the Settlement Agreement itself was approved by Judge Barry Kurren who had undisclosed CONFLICTS OF INTEREST, which were unknown to Harmon at the time of his signing of the Agreement. Further still, Judges Kevin Chang, David Ezra and Robert Faris also have undisclosed material CONFLICTS OF INTEREST, as described in their witness descriptions.

Pacer: U.S. Party/Case Query. This Exhibit, consisting of a Case Summary, Parties, Attorneys and Civil Docket for Case No 1:99-CV-00304-DAE-BMK (the RICO case), provides factual evidence that the Settlement and Indemnification Agreement, and the negotiations leading to that Agreement, were fraudulent and deceptive, and that the ONLY LEGAL PARTIES IN INTEREST during the settlement negotiations, and at the time the Settlement Agreement was signed, were Defendant Bobby N. Harmon and P&C Insurance Company, represented by Attorney Jeffrey H.K. Sia. As this Exhibit shows, all other parties - and their attorneys - were TERMINATED on 08/09/1999, due to a breach of fiduciary duties by Trustee Mary Lou Woo, and her attorney Steven Guttman, by their failure to timely file an amended complaint against all other parties named in the RICO lawsuit as noticed to Trustee Woo by my then-attorney Arnold Phillips in his letter to her dated 10/29/99 (Exhibit C). Consequently, all actions which followed in this case - the settlement negotiations (with representations to me and the court that ALL PARTIES IN INTEREST and their attorneys were participating in the Settlement negotiations and would be signatories to the Agreement), the Settlement Agreement itself, the Arbitration, etc. - were fraudulent; therefore, making the both the Settlement Agreement and the subsequent Arbitration Award invalid and unenforceable under law.

Steven Guttman letter to James Farris, American Arbitration Association, providing a list of names of individuals with whom Defendant “should be barred from communicating with in any manner, either directly or indirectly, by correspondence, copies of correspondence, emails, facsimiles, telephone or any other means of communication.” This exhibit provides clear evidence that Trustee Mary Lou Woo, in collusion with Arbitrator Judith Neustadter Fuqua, were attempting to violate Defendant’s right to freedom of speech in an obvious effort to obstruct justice in various legal cases.
