RE:   CV05-00030 - Woo vs. Harmon - Motion for Assessment of Damages

Dear Mr. Guttman:

With reference to Exhibit 5 attached to your Motion for Assessment of Damages which lists my alleged “Website Violations”, and seeks sanctions against me in the amount of $500 per day for each separate page (total of $111,000.00 to date), although I can identify most of the website pages for which you are alleging these violations, I am unable to identify the one which is labeled as “Harmon’s Letter to the FBI”. This is because I have at least four such letters on the site, which are located at the following addresses:

www.the-catbird-seat.net/FBI-4-12-98.htm

www.the-catbird-seat.net/FBI-9-17-98.htm

www.the-catbird-seat.net/FBI-IRS-AG-Matsumoto-5-13-99.htm

www.the-catbird-seat.net/FBI-5-17-99.htm

Could you please advise which of these letters you are referring to in your Exhibit 5, in order that I may prepare my defense in a timely manner. As I have stated in previous letters and court documents, it is my belief that Arbitrator Judith Neustadter Fuqua was biased and conflicted in this case, and that she did not have the legal authority to censor these, or any other news media. I fully intend to assert my First Amendment rights to post these letters in any public forum, whether it be in the form of Letters to the Editors in newspapers, or on other websites such as Free Republic or Transparency International.

I can also inform you that I have sent additional correspondence to the FBI regarding these matters which I have not provided to you, or posted on any website, as I consider them to be confidential. If I do decide later on to post them on another website (say on Free Republic), will you be asking for $500.00 a day sanctions for each posted letter?

Thank you for your prompt response.

Very truly yours,

Bobby N. Harmon
