As I have not yet received a response from P&C Insurance Company, Inc. (“P&C”) to my previous Tender of Defense dated March 7, 2005, this letter again presents my Notice of Claim to P&C for my defense in the subject lawsuit. I am claiming these defense coverages in accordance with the terms of the hold harmless and indemnity agreement that P&C maintains with its officers and directors. The latest action in this case is a Rule 16 Scheduling Order, which was filed in the United States District Court, District of Hawaii, on April 11, 2005, a copy of which can be found in the internet site listed above. I respectfully ask that you acknowledge receipt of this demand for indemnification, and that an independent, authorized claims representative for P&C Insurance Company contact me right away for additional details and to arrange the appointment of an attorney to defend me in this case.
