Dear Ms. Clarke:


This is to inform you that I have not received a response to my Tender of Defense letter to you dated April 26, 2005. I consider this latest failure of P&C Insurance Company to respond in a timely manner to a Notice of Claim to be a violation of Hawaii Insurance Statutes. More importantly, it can only lead to further costly delays in the ultimate settlement of the referenced lawsuit as well as all the other outstanding claims that I presently have against various entities.


The consequences of the failure to respond to claims and settlement proposals can be illustrated by a review of my letter dated June 18, 1997, to Robert Katz of Torkildson Katz Fonseca Jaffe Moore & Hetherington. A copy of this letter can be found on the Internet at:

It had been my intent to submit a formal complaint to the Hawaii Insurance Division regarding this unfair claims practice; however, since Mary Lou Woo has unexpectedly, and prematurely, obtained a Summary Judgment against me in this case, I have decided to give your company another opportunity to respond to my Tender of Defense before submitting another formal complaint to the Hawaii Insurance Division, or to any other authorities. Due to the urgency of this matter, and the fact that your response is already long overdue, I request that you have P&C Insurance Company’s authorized claims representative respond to this latest Tender of Defense within TEN DAYS. Your cooperation will be appreciated.
