This witness is expected to testify regarding the improper withholding of Harmon’s personnel records which were subject to legal subpoena in Defendant’s Unemployment Insurance claim with the Hawaii Department of Labor. As alleged in Harmon’s subsequent RICO lawsuit, this withholding of information only because the matter was “currently in litigation” constitutes obstruction of justice and a violation of Defendant’s First Amendment rights. Ms. Koza is expected to testify as to who advised her that Harmon’s personnel records should not be released because the matter was “currently in litigation.” This witness is also expected to testify regarding her business, professional and personal relationships with Nathan Aipa, Colleen Wong, Louanne Kam, Christine Lee, Earlene Garvey, Sandie Wicklein, Henry Peters, Gilbert Tam, Rodney Park, Edwina Clarke, Hamilton McCubbin, Dee Jay Mailer, P&C Insurance Co., John Mullen & Co., Marsh & McLennan, Inc., Federal Insurance Co. (Chubb Group), and others to be determined upon discovery.
