This witness is expected to testify regarding the facts and circumstances of the appointment of Judith Neustadter Fuqua as arbitrator in this case. In particular, she is expected to testify regarding any private conversations or correspondence between herself and Steven Guttman, or any other involved parties, pertaining to the nomination, selection and approval of Judith Neustadter Fuqua. She is expected to testify as to AAA’s selection and appointment procedures, and explain the reasons why Ms. Fuqua was appointed in this case, despite the fact that her name did not appear on either the lists of approved arbitrators for the American Arbitration Association, or those of the Hawaii District Court (as approved by Judges Kevin Chang and David Ezra.) Julie Schermerhorn is also expected to testify as to the reasons why Judith Neustadter Fuqua’s appointment was approved despite Defendant’s many factual objections to her appointment due to conflicts of interest and the appearance of bias.
Julie Schermerhorn is also expected to provide the names, addresses and telephone numbers of her organization’s professional liability insurance carrier, and their policy number, policy period, and the date the claim was reported, for each of the notices of claims Defendant submitted against her and the American Arbitration Association.
Julie Schermerhorn is also expected to testify regarding her business, professional, personal and political relationships with Steven Jay Katzman, Brent Wilkes, Barron Hilton, Lamar Hunt, James Nicholson, Randy “Duke” Cunningham, Ron Roberts, Jack Abramoff, Judith Neustadter Fuqua, Mary Lou Woo, Steven Guttman, and others to be named upon discovery.
