This witness is expected to testify regarding the facts and circumstances of the appointment of Judith Neustadter Fuqua as arbitrator in this case. In particular, he is expected to testify regarding any private conversations or correspondence between himself and Steven Guttman, or any other involved parties, pertaining to the nomination, selection and approval of Judith Neustadter Fuqua. He is expected to testify as to AAA’s selection and appointment procedures, and explain the reasons why Ms. Fuqua was appointed in this case, despite the fact that her name did not appear on either the lists of approved arbitrators for the American Arbitration Association, or those of the Hawaii District Court (as approved by Judges Kevin Chang and David Ezra.)
Justin Schuck is also expected to testify as to the reasons why Judith Neustadter Fuqua’s appointment was approved despite Defendant’s many factual objections to her appointment due to material conflicts of interests. This witness is also expected to provide the names, addresses and telephone numbers of the American Arbitration Association’s professional liability insurance carrier, their policy number and policy period.
Justin Schuck is also expected to testify regarding his business, professional, and personal relationships with Judith Neustadter Fuqua, Steven Guttman, James B. Nicholson, David Farmer and June Jones.
