John D. Zalewski is a director and shareholder of the Case Lombardi & Pettit law firm in Honolulu. Mr. Zalewski is a member of the firm’s Litigation and Dispute Resolution practice. His practice is devoted to commercial and civil litigation in Hawaii, with an emphasis in matters involving the zealous defense of commercial, professional, and nonprofit enterprises and their directors and officers, complex accounting, financial, fraud and damage issues and transactions, contract, warranty and tort claims, employment disputes, and civil rights cases.

Mr. Zalewski has practiced litigation and advocacy in Hawaii for 20 years. He has served as lead counsel in successful jury and bench trials in the United States District Court for the District of Honolulu and in all of Hawaii’s state circuit courts, and in numerous arbitration and mediation forums. His background includes having practiced as a licensed CPA for an international accounting firm, and as a prosecutor of white collar criminal cases for the Hawaii Attorney General’s office. He has achieved the rank of Godan in the Japanese martial art of Kendo.

Some of Mr. Zalewski’s recent achievements include:

• Successful resolution of professional liability claims in U.S. District Court against an international accounting firm for a fraction of over $20 million in claimed damages.

• Convinced a Hawaii state court judge to order arbitration by a replacement accountant rather than litigation or arbitration by a lawyer in an action seeking $20 million in damages.

• Convinced a Hawaii state court judge to enforce a 20-year old restrictive covenant between the parties’ predecessors in interest despite the senior judge from the same circuit having previously rejected the identical defense in a related action.

• Obtained summary judgment in favor of directors and officers sued for over $300,000 in alleged improper expenditures.
• Won dismissal of claims in the U.S. District Court against an employer and directors and officers brought under the federal Fair Labor Standards Act and civil rights statutes.

• Obtained summary judgment in U.S. District Court in favor of a condominium association and its board of directors under the federal Fair Housing Act. Lanier v. AOAO Villas of Kamali‘i, 2007 U.S. Dist. LEXIS 18867 (D. Haw. 2007)

• Obtained no cause determinations by Hawaii Civil Rights Commission in several cases charging discrimination under various federal and Hawaii employment and civil rights statutes.
