RE: Harmon Ch. 7 Bankruptcy Case No. 99-04339
Kamehameha Schools - IRS Forms W-2 and 1099-R
Dear Ms. Woo:
This is a follow-up to my many previous letters regarding the failure of Kamehameha Schools to issue the required IRS Forms W-2 and 1099-R for the year 2000. The latest letter, to which Mr. Guttman has not responded, was dated December 17, 2002.
As I have indicated in these letters, I believe that the failure of Kamehameha Schools to withhold proper Social Security taxes for the wages received in the settlement of my Racketeer Influenced Corrupt Organizations (RICO) lawsuit, constitutes both tax and pension plan fraud and is a breach of the Settlement Agreement which I signed on January 27, 2000.*
Since it is now time for filing taxes for 2002, I feel it is extremely urgent that you take action to seek Kamehameha Schools’ immediate compliance with the terms of the appropriate IRS and ERISA regulations. If they fail to comply, I ask that you declare them in breach of the Settlement Agreement, and take whatever legal actions may be necessary in order to enforce compliance.
Sincerely yours,
Bobby N. Harmon
