RE:   Request for Criminal Investigation of Marsh & McLennan, Inc.; Aon Corporation; Federal Insurance Co. (Chubb Group); XL Insurance; Kamehameha Schools; P&C Insurance Co.; PricewaterhouseCoopers, et al.

  

Dear Attorney General Bennett:


This is to inquire again into the status of my December 10, 2004 and May 5, 2005, letters to your office requesting a criminal investigation into the activities of the referenced companies in the State of Hawaii.


This is also to advise you that I have received a letter dated May 19, 2005, from Mr. Albert N. Moskowitz, Section Chief, Criminal Section, Civil Rights Division of the U.S. Department of Justice, in which he writes:

 

“This is a response to the facsimile to Hawaii Attorney General Mark Bennet’s office, dated May 5, 2005. Your correspondence was forwarded to this office. In your correspondence you request immediate action be taken against numerous corporations.

 

“The Criminal section of the Civil Rights Division has the responsibility of enforcing federal civil rights statutes. The enforcement activity involves deprivation of civil rights under color of law, generally police brutality (18 U.S.C. §§ 241 and 242)....

 

“We have carefully reviewed the information which you furnished. However, we have concluded that your complaint does not involve a prosecutable violation of federal criminal civil rights statutes. This is not a judgment on the truth or merit of your complaint, it is simply to inform you that this is not the type of case that this office could prosecute. Accordingly, we are unable to assist you.”...


Mr. Bennett, this letter from the U.S. Department of Justice is of great concern to me and raises a number of questions.


First, my previous letters to you regarding this matter request a criminal investigation of the reference companies based upon alleged “bid-rigging, over-charging, bribery, accepting kick-backs, racketeering, or other illegal activities.” There were no reports or allegations of civil rights violations. Therefore, I do not understand why you would send a copy of my May 5, 2005 letter to the Civil Rights Division of the U.S. Department of Justice for a response.


Second, I must question why your office did not acknowledge receipt of my letters, as I had requested, and why you would forward these letters to the U.S. Department of Justice without advising me of the action you were taking, or sending me a copy of your letter to the DOJ.


Third, as I stated in my May 5, 2005 letter, several other states have already brought action and settled claims in the hundreds of millions of dollars with some of these companies, so there appears to be little doubt that these are serious, prosecutable crimes and that they fall under state jurisdiction.


Therefore, I again request that your office act immediately to take action against any companies that may be involved in the criminal activities that I have documented and reported to your office over the past eight years.
