Re: Notice of Claim Against Island Insurance Company, Inc.
Dear Mr. Matsumoto and Ms. Gilchrist:
This is to inform you that I have not received a response to my Notice of Claim letters dated September 23, 2004 and September 27, 2004, addressed to Casimer Fidele, Jr. in your Claims Department. It is due to this failure to respond that I am now directing this letter to your attention in your positions as the CEO and President/COO of Island Insurance Companies.
For your information, I stated in my letter of September 23, 2004: “Based upon NEW information recently disclosed during the subject arbitration proceedings, I am hereby giving this Notice of Claim against Island Insurance Company, Inc., and your appointed attorney, Roy F. Hughes Esq., for bad faith, fraud, conspiracy to commit fraud, obstruction of justice, racketeering, and other wrongful acts. For references, I refer you to my letters to Roy Hughes dated November 3, 2000; May 2, 2003; and May 28, 2003; and my letters to you dated June 3, 2003 and August 27, 2003.“
In my letter dated September 27, 2004, I gave additional new information regarding material conflicts of interests between Island’s Attorney, Michael Tanoue, Judge Kevin Chang, Kamehameha Schools, and others. The latest update to this conflict issue, is the fact that I have been ordered by Chief U.S. District Judge David A. Ezra to appear for a Scheduling Conference/Status Conference on April 11, 2005, before Judge Kevin S.C. Chang.
First of all, as this Conference is to hear the Application by Plaintiff-Trustee Mary Lou Woo For Confirmation of Arbitration Award And For Entry Of Judgment Against Bobby N. Harmon, I am again tendering defense of this case to Tradewind Insurance Company under the terms and conditions of Homeowner’s Policy THB-2951831.
Second, due to your wrongful denial to accept my original tender regarding the mandatory arbitration, this is to notify you that I will be looking to your company for full payment of all legal costs and damage awards arising out of the arbitration proceedings in this case.
Third, I am requesting that you have an authorized claims representative from your Professional Liability Insurance carrier contact me immediately to begin their investigation into my claims against Island Insurance Company of bad faith, fraud, conspiracy to commit fraud, obstruction of justice, racketeering, and other wrongful acts.
