RE: New Settlement Proposal for Claims Against Trustees of Kamehameha Schools, Its Subsidiaries, and Its Employees.
Dear Trustees and Ms. Mailer:
Since I received no response to my last settlement offer dated June 29, 2005, that offer expired on July 10, 2005. Therefore, I hereby make the following revised proposal:
To settle ALL CLAIMS against KAMEHAMEHA SCHOOLS, its Trustees, and all persons, past and present, employed directly by KAMEHAMEHA SCHOOLS, AND ITS SUBSIDIARIES AND RELATED COMPANIES, with the exceptions of interim trustees Ronald D. Libkuman, Francis A. Keala, and Robert K.U. Kihune, as individuals, and the Officers and Directors of P&C INSURANCE COMPANY, INC., I will accept the SUM OF $1.00 (One Dollar). However, based upon new information arising from the case of Woo vs. Harmon, CV05-0030, I am hereby making NEW CLAIMS of fraud, racketeering, and obstruction of justice against the three interim trustees who wrongfully, and without proper legal authority, signed the Settlement and Indemnity Agreement in Case 99-04339. To settle all claims against Ronald D. Libkuman, Francis A. Keala, and Robert K.U. Kihune, as individuals, I will accept the sum of $1,000 per day for each individual, beginning from the date they signed the Settlement and Indemnity Agreement (April 11, 2000), to the date that these new claims may be settled. These amounts, as well as the terms of any settlement agreement that might be reached, are negotiable.
I respectfully ask that you have an authorized Claims Representative for P&C Insurance Company, or other insurance carrier(s), if applicable, contact me as soon as possible for further information regarding these new claims.
These settlement offers will remain open until 5:00 p.m., Hawaii time, August 31, 2005.
