Dear Mr. Tameler:
This is to respond to your letter of January 23, 2003 in which you state, “In order to avoid any misunderstanding, please be advised that based upon the information we have available to us at this time, ALPS denies your claim against Mr. Tamm and Mr. Dunn. As previously requested, if you believe there is information which we do not have which you believe would change our evaluation, you must provide that information to us in order that we can re-evaluate this matter.”
Please be advised that my purpose in sending Mr. Tamm copies of my letters, regarding matters which pertain to my claims, was to comply with your request that I provide that information for your reevaluation. The copy of my letter of January 27, 2003, addressed to Trustee Mary Lou Woo, is another example of my providing new information as you have requested.
I understand your advice that there are time limitations that I may have to assert a claim. I trust you also have advised your clients on these time limitations. I might also suggest that you advise them on whether or not your insurance policy covers them against the consequences of criminal suits as well as civil actions.
I note that you now reference two claim numbers. Would you please advise as to which specific claim, or claims, each of these numbers apply. Thank you.
