RE:    NEW PROFESSIONAL LIABILITY CLAIM - HARMON v. TAMM & DUNN

           IRS Levy on Bank Account - Ref. Prior ALPS Claim Numbers B023134 & B023235

 

Dear Mr. Tameler:


This is to file yet another NEW professional liability claim against your insureds, Bradley Tamm and Gregory Dunn. This claim arises out of their failure to properly handle the bankruptcy filing which resulted in the execution of a levy against my personal savings account on or around June 27, 2001.


When my wife and I had our initial interviews with Mr. Dunn, our understanding was that filing bankruptcy would stop all IRS collection efforts and that an automatic stay is invoked that would prevent the agency from levying our bank accounts or paychecks, or taking our property. Obviously, in our case, this representation was later found to be false.


I realize that the final IRS action occurred after February 28, 2001, the date the court granted the Motion of Tamm and Dunn to Withdraw as Attorneys for Debtor; however, the actual damages did not arise until after that date.


Your acknowledgment of this claim is requested along with a new claim number.
