Dear Mr. Tsukazaki:
As you, and your professional liability insurance company, have failed to respond to my prior reports of claims, I am hereby sending you this new Notice of Claim against you, Robert Katz, Esq., your law firm, Torkildson Katz Fonseca Moore & Hetherington, and your undisclosed professional liability insurance carrier(s) for bad faith due to the failure to respond to my Notice of Claim dated March 4, 2005.
For this bad faith failure to respond in a timely manner to a legitimate Notice of Claim, I am asking for the sum of Five Hundred Thousand Dollars ($500,000.00) from you, as an individual; plus the sum of Five Hundred Thousand Dollars ($500,000.00) from Robert Katz, as an individual; plus One Million Dollars ($1,000,000) from your law firm, Kessner Duca Umebayashi Bain & Matsunaga; plus Five Million Dollars ($5,000,000), from your professional liability insurance carrier(s).
As you have not disclosed the names of your insurance carrier(s), I am directing this Notice of Claim to you with the demand that you submit this NEW CLAIM immediately to your insurance carrier(s) and request that a licensed claims adjuster contact me as soon as possible, but in no event longer than 15 days.
I also ask that you immediately acknowledge receipt of this Notice of Claim, and advise me of the date when you submitted this Notice to your insurance agent and/or insurance carrier(s). Any failure of you, and/or your insurance agent and/or carrier(s), to respond to this Notice of Claim, will be considered another act of bad faith and will result in further claims.
