Thank you for sending me the copy of your letter dated March 10, 2005, addressed to the Hawaii Supreme Court, Office of Disciplinary Counsel, in which you write:
“Enclosed please find a complaint from Bobby N. Harmon who complains of conflict of interest and breach of privileged communication of his case by attorney Michael N. Tanoue. As it appears that appropriate jurisdiction may rest with your office, we are forwarding Mr. Harmon’s complaint to your attention for further handling. By copy of this letter, Mr. Harmon will be advised of your involvement.”
Although you do not state in your letter which of my complaints regarding Michael N. Tanoue you are forwarding to the Hawaii Supreme Court, I believe you are referring to my letter dated March 7, 2005, addressed to Mr. Colbert Matsumoto, CEO, Island Insurance Company, which was referenced “Notice of Claim Against Island Insurance Company, Inc.” If this is the letter to which you are referring, then this matter does involve complaints which properly come under the jurisdiction of the State of Hawaii Insurance Division, Department of Commerce and Consumer Affairs.
At the present time, I do have various outstanding complaints filed with your office against various insurance companies, agents and claims administrators which involve fraud, bribes, bid-rigging, racketeering, unfair claims practices, and other wrongful acts in violation of Hawaii Insurance Statutes. These companies include Federal Insurance Co. (Chubb Group); Marsh & McLennan, Inc.; P&C Insurance Company (the captive of Kamehameha Schools); St. Paul Travelers; Island Insurance Company, and others yet to be identified. These yet unidentified companies include the Professional Liability Insurance carriers, and their agents, brokers and outside legal counsel, for Kamehameha Schools; P&C Insurance Company; the Chubb Group; Marsh & McLennan; Island Insurance Company; Roy Hughes, Esq.; Trustee Mary Lou Woo; Torkildson Katz Fonseca Jaffe Moore & Hetherington; John Mullen & Co.; Aon Insurance Managers; Rush Moore Craven Sutton Morry & Beh; Judith Neustadter Fuqua, Esq. and The American Arbitration Association. I am still awaiting responses to my Claims Notices and Settlement Proposals to some of these various entities in order to determine if I need to file further complaints with your office. Hopefully, some, if not all, of these outstanding claims can be settled through private negotiation between these parties and myself so that further complaints will not be necessary.
In order to keep your office advised of the progress in these matters, however, I do intend to continue to send copies of all correspondence related to unresolved complaints to the Commissioner. Since there are a number of related complaints, may I suggest that it might help to expedite matters if one investigator in your office were assigned to answer ALL of my complaints. For your reference, I am still awaiting responses to the following complaints:
