Dear Gentlemen and Ms. Houk:

This is to report what may be an attempt to obstruct justice in the subject case.

I am the Respondent in Arbitration Case No. 74 166 00491 03 JUSC, Mary Lou Woo, Trustee v. Bobby N. Harmon. Despite my repeated objections, the American Arbitration Association (“AAA”) has appointed Judith Neustadter, Esq. as the Arbitrator in this case. As stated in your lawsuit, Judith Neustadter Fuqua was the Maui Planning Commission Hearing Officer who recommended denial of the Hale O Kaula Church’s application for a Special Use Permit.

In my objections to the appointment of Ms. Neustadter as Arbitrator, I have expressed to the AAA that I believe her position on the Maui Planning Commission, and her involvement in the subject case, constitute a material conflict-of-interest. I am attaching copies of my letters to the AAA dated August 5, 7, and 8 (two), 2003, which further explain my involvement and concerns regarding this matter.
