And to some it was a = premeditated conspiracy to move covert funds out of the country for use = by the=20 U.S. Intelligence Agency (Bainerman, 1992: 275). All of these depictions = of the=20 S & L scandal contain elements of truth. But to a large degree, the = savings=20 and loan scandal was simply business as usual. What was unusual about it = was not=20 that it happened, or who was involved, but that it was so blatant and = coarse a=20 criminal act that exposure became inevitable. But with its exposure, = three basic=20 but usually ignored "truths" about organized crime were once again = demonstrated=20 with startlingly clarity:

There is precious little difference = between=20 those people who society designates as respectable and law abiding and = those=20 people society castigates as hoodlums and thugs.

The world of = corporate=20 finance and corporate capital is as criminogenic and probably more = criminogenic=20 than any poverty-wracked slum neighborhood.

The distinctions = drawn=20 between business, politics, and organized crime are at best artificial = and in=20 reality irrelevant. Rather than being dysfunctions, corporate crime,=20 white-collar crime, organized crime, and political corruption are = mainstays of=20 American political-economic life.

It is not our intent to discuss = the=20 unethical and even illegal business practices of the failed savings and = loans=20 and their governmental collaborators. The outlandish salaries paid by S = & L=20 executives to themselves, the subsidies to the thrifts from Congress = which=20 rewarded incompetence and fraud, the land = "flips"=20 which resulted in real estate being sold back and forth in an endless = "kiting"=20 scheme, and the political manipulation designed to delay the scandal = until after=20 the 1988 presidential elections are all immensely interesting and = important.=20 But they are subjects for others' = inquiries. Our=20 interest is in the savings and loans as living, breathing organisms that = fused=20 criminal corporations, organized crime, and the CIA into a single entity = that=20 served the interests of the political and economic elite in America. Let = us=20 begin by quickly summarizing the most blatant examples of collaboration = between=20 financial institutions, the mob, and the intelligence = community.

First=20 National Bank of Maryland: For two years, 1983-1985, the First National = Bank of=20 Maryland was used by Associated Traders, a CIA proprietary company, to = make=20 payments for covert operations. Associated traders used its accounts at = First=20 National to supply $23 million in arms for covert operations in = Afghanistan,=20 Angola, Chad, and Nicaragua (Bainerman, 1992; 276-277; Covert Action 35, = 1990).

The links between the First National Bank of Maryland and = the CIA=20 were exposed in a lawsuit filed in Federal District Court by Robert = Maxwell, a=20 high-ranking bank officer. Maxwell charged in that suit that he had been = asked=20 to commit crimes on behalf of the CIA. Specifically, he charged that he = was=20 asked to conceal Associated Traders' business activities, which by law = he was=20 required to specify on all letters of credit. Maxwell alleged that he = had been=20 physically threatened and forced to leave his job after asking that his=20 superiors supply him with a letter stating that the activities he was = being=20 asked to engage in were legal. In responding to Maxwell's lawsuit, = attorneys for=20 the bank state that "a relationship between First National and the CIA = and=20 Associated Traders was classified information which could neither be = confirmed=20 nor denied (Bainerman, 1992: 276-277; Washington Business Journal, = =20 February 5, 1990).

Palmer National Bank: The Washington, = D.C.-based=20 Palmer National Bank was founded in 1983 on the basis of a $2.8 million = loan=20 from Herman K. Beebe to Harvey D. McLean, Jr. McLean was a Shreveport = Louisiana=20 businessman who owned Paris (Texas) Savings and Loan. Herman Beebe = played a key=20 role in the savings and loan scandal. Houston Post reporter Pete Brewton = linked=20 Beebe to a dozen failed S & L's, and Stephen Pizzo, Mary Fricker, = and Paul=20 Muolo, in their investigation of the S & L fiasco, called Beebe's = banks=20 "potentially the most powerful and corrupt banking network ever seen in = the=20 U.S." Altogether, Herman Beebe controlled, directly or indirectly, at = least 55=20 banks and 29 S & L's in eight states. What is particularly = interesting about=20 Beebe's participation in these banks and savings and loans is his unique = background. Herman Beebe had served nine months in federal prison = for=20 bank fraud and had impeccable credentials as a financier for New = Orleans-based=20 organized crime figures, including Vincent and Carlos Marcello = (Bainerman, 1992:=20 277-278; Brewton, 1993: 170- 179).

Harvey McLean's partner in the = Palmer=20 National Bank was Stefan Halper. Halper had served as George Bush's = foreign=20 policy director during the 1980 presidential primaries. During the = general=20 election campaign, Halper was in charge of a highly secretive operations = center,=20 consisting of Halper and several ex- CIA operatives who kept close tabs = on Jimmy=20 Carter's foreign policy activities, particularly Carter's attempt to = free U.S.=20 hostages in Iran. Halper was later linked both to the "Debategate" = scandal, in=20 which it is alleged that Carter's briefing papers for his debates with = Ronald=20 Reagan were stolen, and with "The October Surprise," in which it is = alleged that=20 representatives of the Reagan campaign tried to thwart U.S. efforts to = free the=20 Iranian hostages until after the presidential election. Halper also set = up a=20 legal defense fund for Oliver North.

During the Iran-Contra = Affair,=20 Palmer National was the bank of record for the National Endowment for = the=20 Preservation of Liberty, a front group run by Oliver North and Carl = "Spitz"=20 Channell, which was used to send money and weapons to the = contras.

Indian=20 Springs Bank: Another bank with clear connections to the CIA was the = Indian=20 Springs Bank of Kansas City, Kansas (Bainerman, 1992: 279-280; Brewton, = 1993:=20 197-200). The fourth largest stockholder in Indian Springs was Iranian=20 expatriate Farhad Azima, who was also the owner of an air charter = company called=20 Global International Air. The Indian Springs bank had made several = unsecured=20 loans to Global International Air, totaling $600,000 in violation of the = bank's=20 $349,00 borrower limit. In 1983 Global International filed for = bankruptcy, and=20 Indian Springs followed suit in 1984. The president of Indiana Springs = was=20 killed in 1983 in a car fire that started in the vehicle's back seat and = was=20 regarded by law enforcement officials as of suspicious = origins.

Global=20 International Air was part of Oliver North's logistical network which = shipped=20 arms for the U.S. government on several occasions, including a shipment = of 23=20 tons of TOW missiles to Iran by Race Aviation, another company owned by = Azima.=20 Pete Brewton, in his investigation of the Indian Springs bank collapse = was told=20 that FBI had not followed up on Indian Springs because the CIA informed = them=20 that Azima was "off limits" (Houston Post, February 8, 1990). Similarly = the=20 assistant U.S. Attorney handling the Indian Springs investigation was = told to=20 "back off from a key figure in the collapse because he had ties to the=20 CIA."

Azima did indeed have ties to the CIA. His relationship = with the=20 agency goes back to the late 1970s when he supplied air and logistical = support=20 to EATSCO (Egyptian American Transport and Services Corporation), a = company=20 owned by former CIA agents Thomas Clines, Theodore Shackley, and Richard = Secord.=20 EATSCO was prominently involved in the activities of former CIA agent = Edwin=20 Wilson, who shipped arms illegally to Libya. Azima was also closely tied = to the=20 Republican party. He had contributed $81,000 to the Reagan=20 campaign.

Global International also had other unsavory = connections. In=20 1981, Global International made a payment to organized crime figure = Anthony=20 Russo, a convicted felon with a record that included conspiracy, = bribery, and=20 prostitution charges. Russo was the lawyer of Kansas City organized = crime=20 figures, an employee of Indian Springs, and a member of the board of = Global=20 International. Russo later explained that the money had been used to = escort=20 Liberian dictator Samuel Doe on a "goodwill trip" to the = U.S.

Global=20 International's planes based in Miami were maintained by Southern Air = Transport,=20 another CIA proprietary company. According to Franck Van Geyso, an = employee of=20 Global International, pilots for Global International ferried arms into = South=20 and Central America and returned to Florida with drugs. Indian Springs = also made=20 a loan of $400,000 to Morris Shenker, owner of the Dunes Hotel in Las = Vegas,=20 former attorney for Jimmy Hoffa, and close associate of Nick Civella and = other=20 Kansas City organized crime figures. At the time the loan to Shenker was = made,=20 he, Civella, and other Kansas City mobsters were under indictment for = skimming=20 $280,000 from Las Vegas' Tropicana Casino.

Vision Banc Savings: = In March,=20 1986, Robert L. Corson=20 purchased the Kleberg County Savings and Loan of Kingsville, Texas, for = $6=20 million, and changed its name to Vision Banc Savings (Bainerman, 1992: = 280-281;=20 Brewton, 1993: 333-351). Harris County, Texas, judge Jon Lindsey vouched = for=20 Corson's character in order to gain permission from state regulators for = the=20 bank purchase. Lindsey was the chairman of the Bush campaign in 1988 in = Harris=20 County and later received a $10,000 campaign contribution and a free = trip to Las=20 Vegas from Corson (Houston Post, February 11, 1990).

Corson was well-known to = federal law=20 enforcement agents as a "known money launderer" and a "mule for the = agency,"=20 meaning that he moved large amounts of cash from country to country. = When Corson=20 purchased Vision Banc, it had assets in excess of $70 million. Within = four=20 months it was bankrupt. Vision Banc engaged in a number of questionable = deals=20 under Corson leadership, but none more so that its $20 million loan to = Miami=20 Lawyer Lawrence Freeman to finance a real estate deal (Houston Post, = February 4,=20 1990). Freeman was a convicted money launderer who had cleaned dirty = money for=20 Jack Devoe's Bahamas-to-Florida cocaine smuggling syndicate and for = Santo=20 Trafficante's Florida- based organized crime syndicate. Freeman was a = law=20 partner of CIA-operative and Bay of Pigs paymaster Paul Helliwell. = Corson, in a=20 separate Florida real estate venture costing $200 million, was indicted = on a=20 series of charges.

Hill Financial Savings: Vision Banc was not = the only=20 financial institution
involved in Freeman's Florida land deals. Hill=20 Financial Savings of Red Hill, Pennsylvania, put in an additional $80 = million=20 (Brewton, 1993: 346-348) . The Florida land deals were only one of a = series of=20 bad investments by Hill Financial which led to collapse. The failure of = Hill=20 Financial, alone, cost the U.S. treasury $1.9 billion.

Sunshine = State=20 Bank: The cast of characters surrounding the Sunshine State Bank of = Miami also=20 included spies, White House operatives, and organized criminals = (Bainermann,=20 1992: 281; Brewton, 1993: 310- 312, 320-323). The owner of the Sunshine = State=20 Bank, Ray Corona, was convicted in 1987 of racketeering, conspiracy, and = mail=20 fraud. Corona purchased Sunshine in 1978 with $1.1 million in drug = trafficking=20 profits supplied by Jose Antonio "Tony" Fernandez, who was subsequently = indicted=20 on charges of smuggling 1.5 million pounds of marijuana into the=20 U.S.

Among Corona's customers and business associates were = Leonard=20 Pelullo, Steve Samos, and Guillermo Hernandez-Cartaya. Pelullo was a = well-known=20 associate of organized crime figures in Philadelphia, who had attempted = to use S=20 & L money to broker a major purchase of an Atlantic City Casino as a = mob=20 frontman. Pelullo was charged with fraud for his activities at American = Savings=20 in California. Steve Samos was a convicted drug trafficker who helped = Corona to=20 set up Sunshine State Bank as a drug money laundry. Samos also helped = set up=20 front companies that funneled money and weapons to the Contras.=20 Guillermo
Hernandez-Cartaya was a veteran CIA operative who had = played a key=20 role in the Bay of Pigs of invasion. He also had a long career as a = money=20 launderer in the Caribbean and in Texas on behalf of both the CIA and = major drug=20 trafficking syndicates.

Mario Renda, Lender to the Mob: Mario = Renda was a=20 Long Island money broker who brokered deposits to various savings and = loans in=20 return for their agreement to loan money to phony companies (Brewton, = 1993:=20 45-47; 188-190; Pizzo et al. 1989: 466-471). Renda and his associates = received=20 finders fees of 2 to 6 percent on the loans, most of which went to = individuals=20 with strong organized crime connections who subsequently defaulted on = them.=20 Renda brokered deals to 160 Savings and Loans throughout the country, = 104 of=20 which eventually failed. Renda was convicted of $16 million from an S = & L=20 and for tax fraud.

Renda also served CIA and National Security = Council=20 interests as a money broker helping arrange for the laundering of drug = money=20 through various savings and loans on behalf of the CIA. He then obtained = loans=20 from the same S & L's, which were funneled to the Contras. An = organized=20 crime-related stockbroker, a drug pilot, and Renda were all convicted in = the=20 drug money laundering case.

Full-Service Banking: All told at = least=20 twenty-two of the failed S & L's can be tied to joint money = laundering=20 ventures by the CIA and organized crime figures (Glassman, 1990: 16-21; = Farnham,=20 1990: 90-108; Weinberg, 1990: 33; Pizzo, et al., 1989: 466-471). If the = savings=20 and loan scandals of the 1980s reveal anything, they demonstrate what = has often=20 been stated as a maxim in organized crime research: that corruption = linking=20 government, business, and syndicates is the reality of the day-to-day=20 organization of crime.

Investigations of = organized=20 crime in the United States, Europe, and Asia have all uncovered = organized crime=20 networks operating with virtual immunity from law enforcement and = prosecution.=20 Chambliss' study of organized crime in Seattle exposed a syndicate that = involved=20 participation by a former governor of the state, the county prosecutor, = the=20 police chief, the sheriff, at least 50 law enforcement officers, leading = business people, including contractors, realtors, banks, and corporation = executives, and, of course, a supporting cast of drug pushers, pimps, = gamblers,=20 and racketeers (Chambliss, 1978). The Chambliss study is not the = exception but=20 the rule. Other sociological inquires in Detroit, Texas, Pennsylvania, = New=20 Jersey, and New York have all revealed similar patterns (Albini, 1971; = Block,=20 1984; Block and Chambliss, 1981; Block and Scarpitti,1985; Jenkins and = Potter,=20 1989; 1986; Potter and Jenkins, 1985; Potter, 1994). As Chambliss=20 comments:

In the everyday language of the police, the press, and = popular=20 opinion, "organized crime" refers to a tightly knit group of people, = usually=20 alien and often Italian, that run a crime business structured along the = lines of=20 feudal relationships. This conception bears little relationship to the = reality=20 of organized crime today. Harris County Judge Jon Lindsay received = favors that=20 included a $10,000 campaign contribution and a trip to Las Vegas = from a=20 Houston developer = who is under investigation for his role = in the demise=20 of several federally insured financial institutions, The Houston = Post has=20 learned.=20
Robert L. Corson, an associate of reputed organized crime = figures and=20 an alleged Central Intelligence Agency operative, used a letter of = recommendation from Lindsay in the acquisition of a South Texas = savings=20 and loan that became insolvent four months after Corson bought it. =
Corson, who has been barred from owning or operating any = federally=20 insured financial institutions because of his role in the thrift's = collapse, made his first campaign contribution to Lindsay in March = 1985.=20 It was $100.=20
A month later, The Post has learned, Lindsay wrote a letter of=20 recommendation that Corson submitted to state and federal = regulators who=20 would approve his purchase of Kleberg County Savings and Loan in=20 Kingsville.=20
The letter, dated April 24, 1985, and written on Harris County=20 stationery, was addressed "to whom it may concern" and said: = "Robert=20 Corson is a person well known to me to be of the highest = character."=20
In the months that followed, The Post has learned:=20
Corson gave Lindsay a $10,000 campaign contribution, equaling = the=20 largest single donation he has received during the past eight = years.=20
Corson chartered a business jet and invited Lindsay to = accompany him to=20 Las Vegas to witness prize fights.=20
Corson spent $3,000 on a fund-raising reception at his home for = Lindsay.=20
Lindsay, when asked by The Post about his relationship with = Corson,=20 initially said he was not well-acquainted with the man who is = identified=20 in federal law enforcement records as a "known money launderer."=20
"Where is he at?" Lindsay asked. "Is he in jail yet?"=20
The Post has been unable to reach Corson, who is said to be = staying in=20 San Diego, Calif. Federal prosecutors say there are at least two=20 investigations of alleged S&L fraud that focus on Corson.=20
Lindsay, 54, has been county judge since 1975. A Republican, he = headed=20 George Bush's presidential campaign in Harris County in 1988.=20
Asked by The Post if he had ever done any favors for Corson, = Lindsay=20 responded: "No. Hell no. We were just friends."=20
Houston lawyer Rozanne McKinney, a member of the national = governing=20 board of the citizens lobbying group Common Cause, said Lindsay's=20 relationship to Corson should be investigated by law enforcement=20 authorities, "considering the savings and loan mess and how much = money it=20 has cost."=20
< Last Sunday, The Post reported that Corson is the object = of a=20 federal probe in three states in connection with his role in the = failure=20 of Vision Banc Savings in Kingsville. Vision is one of 22 failed = thrifts=20 where The Post has found evidence of a possible link between the = Central=20 Intelligence Agency and organized crime.=20
The evidence, from court documents and other sources, suggests = that the=20 CIA may have used part of the proceeds from S&L fraud to help = pay for=20 covert operations and other activities that Congress was unwilling = to=20 support publicly.=20
One former CIA operative told The Post that Corson frequently=20 transported large sums of cash from country to country for the = agency.=20
Corson purchased Kleberg County Savings and Loan for $6 million = in=20 March 1986 and changed the name to Vision Banc Savings.=20
When Corson took over, the thrift had assets of $70 million. = Four=20 months later, it was insolvent, in part because of $20 million in = loans=20 that were made to help finance a questionable Florida land deal.=20
In the 1986 transaction, $7 million was wired to a company tied = to=20 narcotics smugglers and drug money launderers in the Isle of = Jersey, a tax=20 haven in the English Channel. About $3 million and a part of the = Florida=20 tract were diverted back to Corson.=20
As Corson was negotiating to buy Kleberg County Savings in = 1985, he=20 submitted Lindsay's letter of recommendation to the thrift's = owners, and=20 to state and federal regulators.=20
Lindsay's letter was one of seven Corson submitted and was the = only one=20 from a public official. Five were written by bankers who had dealt = with=20 Corson, and another was from a corporation that had done business = with=20 him.=20
Kingsville lawyer Nelson Sharpe, the principal owner of Kleberg = County=20 Savings before it was sold to Corson, died last year.=20
Art Leiser, who was chief examiner for the Texas Savings and = Loan=20 Department at the time the thrift was being sold, said he believes = Lindsay's letter helped to persuade the state Savings and Loan=20 commissioner to approve the sale to Corson.=20
Lindsay, in addition to recommending Corson as a man of high = character,=20 wrote: "I have been personally acquainted with him for many years = and know=20 he enjoys an excellent reputation as a good family man and = businessman."=20
The letter concluded: "Mr. Corson has my unreserved = recommendation as a=20 person who will be diligent in any endeavor he pursues."=20
In 1977 divorce = proceedings,=20 Corson's first wife accused him of beating her and smoking = marijuana in=20 front of their children. His first wife was Paula Mischer, the daughter of = Houston=20 businessman and political power broker Walter M. Mischer = Sr.=20
Corson's present wife sued him for divorce in 1982, alleging = that he=20 beat her. She later dropped the suit.=20
When asked by The Post if he recalled writing the letter, = Lindsay said:=20 "No, I don't. Did I? I don't recall doing it. It could have = happened. I do=20 a lot of things like that for people I know."=20

When state regulators = visited=20 Vision Savings in 1986, Leiser said Corson mentioned Lindsay's = name in an=20 effort to intimidate him and his examiners. Lindsay, when told = about=20 Leiser's comments, said in reference to Corson: "I'm sorry I ever = got to=20 know that guy."=20
Asked if he knew about allegations that Corson had used drugs, = Lindsay=20 replied, "No. Actually, I didn't know him that well.=20
"I had dinner with him a couple of times, and he introduced me = to=20 friends," Lindsay said. "He may have been using me in that case. I = didn't=20 know he was using me to that extent."=20
In January 1986, about eight months after Lindsay wrote the = letter of=20 recommendation, Corson donated $10,000 to Lindsay's re-election = campaign.=20
The donation equaled the largest individual contribution = Lindsay has=20 received during the past eight years, his campaign finance records = show.=20
Lindsay said he doesn't remember Corson's $10,000 contribution. = He=20 acknowledged it was a "rather large campaign contribution. But I = think=20 I've had other $10,000 contributions."=20
Records show the only other other $10,000 contribution Lindsay = has=20 received in the last eight years came from Houston engineer James=20 Dannenbaum and his wife. Dannenbaum has been a longtime = contributor to=20 Lindsay.=20
Asked why Corson would contribute so much to his campaign, = Lindsay=20 said, "Well, I guess he was trying to butter me up, think that I = would be=20 able to help him in some way. I thought he was a safe individual = for=20 campaign purposes because I didn't have any business affiliations = with=20 him. He was not an engineer or a contractor or anything like = that."=20
Reminded that Corson was a real estate developer and as such = would be=20 affected by Commissioners Court actions, Lindsay replied, "Yeah, = but we=20 really don't help those developers directly that much. Not like an = engineer."=20
Real estate experts disputed Lindsay's interpretation, noting = that=20 Commissioners Court determines where many roads and flood control = projects=20 are built - two major items which can make or break a land = development.=20
"Commissioners Court and the county flood control district have = been=20 the key to whether certain developments were drained or had = roads," said=20 Jim Blackburn, a Houston environmental lawyer.=20
"Everything Commissioners Court does affects developers, and = developers=20 are very much in close contact with Commissioners Court," said = McKinney of=20 Common Cause.=20
Lindsay said he knew Corson mostly during the early 1980s, a = period=20 when Corson "was blowing and going."=20
Campaign records indicate that Corson's first political = contribution to=20 Lindsay was for $100 in March 1985, about a month before Lindsay = wrote the=20 letter of recommendation.=20
In September 1986, about two months before the election, Corson = hosted=20 a party at his home for Lindsay.=20
Lindsay's campaign records show a contribution from Corson of = $600 for=20 a reception. But Corson spent more than $3,000 for the party, = sources told=20 The Post.=20
It would be a violation of state election laws if Lindsay knew = that=20 Corson spent $3,000 and instead listed it as a $600 contribution = on=20 campaign financial reports.=20
Lindsay said he would be surprised if Corson spent $3,000 for = the=20 party. He said the receipts Corson provided showed that the party = cost=20 $600.=20
"It was not that big a reception," Lindsay said. "There were = only about=20 25 people there."=20
The Post learned that Corson's generosity was not limited to = campaign=20 contributions.=20
In June 1986, Corson chartered a business jet and took Lindsay = to Las=20 Vegas for a boxing match. Corson charged the trip to his savings = and loan.=20
Asked if he ever went on any trips with Corson, Lindsay = replied, "He=20 was on one time that we went on. I forgot who the host was - some = title=20 company, probably doing business with him at one time. I don't = remember=20 where we went."=20
Asked if it was Las Vegas, Lindsay said, "I don't think I've = been to=20 Vegas with him. I've been to Vegas a few times."=20
Told that Corson had charged his S&L for the trip to Las = Vegas to=20 see the fights, Lindsay replied, "Well, I went with a, I went to = that=20 boxing match out there. I don't think it was with Corson. Well, = maybe it=20 was with Corson. Well, it could have been with Corson."=20
Lindsay also acknowledged going on a hunting trip to Mexico = with=20 Corson. "Maybe we went duck hunting around here a time or two," = Lindsay=20 added.=20
Tom Sturdivant, Corson's former chauffeur, told private = investigator=20 P.M. Clinton that Lindsay and Corson were involved in some = business deals=20 together through third parties.=20
But Lindsay denied having any business dealings with Corson.=20 "Absolutely not. I never did any business with Bob Corson," = Lindsay said.=20
Public documents show that Lindsay and Corson were involved in = deals on=20 adjacent pieces of property in west Harris County. This is the = sequence of=20 events:=20
In June 1982, Corson's step-father deeded a 17.56-acre tract of = land at=20 Keith Harrow and Sommerall to Houston real estate investor Monzer = Hourani.=20 In May 1983, Hourani divided the property in two and deeded both = tracts to=20 Green Meadows Apartment Homes, a Texas general partnership which = included=20 a Hourani company. The same day, Green Meadows Apartment Homes = deeded one=20 of the two parcels to Green Meadows Apartment Homes No. 1 Ltd., a = Texas=20 limited partnership.=20
In October 1983, Green Meadows Apartment Homes carved a = 1.42-acre tract=20 out of its parcel and sold it to Corson as a trustee. Sources = close to=20 Corson said he probably was acting as a trustee for himself, his = mother,=20 B.J. Garman, and one or two other close business associates. = Corson built=20 a strip shopping center on this tract.=20
Less than one month after Corson bought this piece of land, = Green=20 Meadows Apartment Homes No. 1 Ltd., sold its tract to Green = Meadows=20 Apartments, Ltd., a limited partnership. Lindsay's investment in = the=20 partnership included $10,773 cash and promissory notes totaling = $72,919.=20
Lindsay said he had "no idea" that Corson had bought the land = and built=20 a strip shopping center on it.=20
"I just bought a limited partnership," Lindsay said. "One of = those=20 regular things that went = broke."

The Skimming and the Shredding

TO: The San Jose Mercury News - = 750 Ridder=20 Park Drive, San Jose, CA, 95190

DATE: April 16, 1994

It seems I was incorrect in my April 8th, 1994 = letter, at least=20 with respect to Lincoln Savings and Loan, in suggesting that federal = regulatory=20 investigators were either incompetent or obstructing justice in not = discovering=20 and reporting the skimming of money for contributions to the 1988 Bush = campaign.=20 This was based on my assumption that the investigators were physically = present=20 in the offices of the S&L at the time the contributions were skimmed = in late=20 September or early October 1988. (The chronology of events cited on = pages=20 340-345 of the book Trust Me: Charles Keating and the Missing=20 Billions by Michael Binstein and Charles Bowden strongly = suggests the=20 money was skimmed during this time.)

On April 13th, 1989, Charles Keating took the = American=20 Continental Corporation (ACC) and number of the ACC subsidiaries into = Chapter 11=20 bankruptcy, building a "legal wall between his assets and the federal=20 government." (page 351) On April 14th, the Federal Government seized = Lincoln=20 Savings and Loan. Three days later, on the 17th of April, Michael = Manning, a fee=20 attorney for the Federal Deposit Insurance Corporation (FDIC), flew into = Phoenix=20 to head a team of lawyers and accountants in the construction of a RICO = criminal=20 case against Keating.

Where = the skimming=20 took place. Why did Manning fly into = Phoenix and=20 not Los Angeles where Lincoln was based? After he had taken over Lincoln = in=20 1984, Keating had convinced someone in the [Republican] Deukmejian = adminstration=20 that the "back-room records" of Lincoln should be removed from = California to a=20 Lincoln S&L's office complex next to ACC's corporate headquarters on = Camelback Drive in Phoenix. In April 1989, Manning and his team moved = into=20 offices in the Lincoln complex to begin a four-month investigation in a = hostile=20 city amidst a hostile [Republican] business community. Manning later = described=20 the Lincoln offices as a "dead zone" across a driveway from an ACC = corporate=20 headquarters building which was "humming with activity." All of = "Lincoln's books=20 seemed to have crossed to the ACC building, where shredding machines = [ran] day=20 and night" (p. 360) Manning could look out his window and "see trucks = pull up=20 and drive away with bags of shredded documents." (p. 6) Nonetheless, = Manning and=20 his team found enough documents to fill a 30,000 square foot archive and = to=20 convict Keating.

Where = did the=20 skimmed money come from? By the fall of = 1988, ACC=20 was having major cash flow problems. As far as I can determine from my = reading=20 of the book Trust Me, the primary source of operating = funds for=20 the corporation and the source of the funds that were = skimmed for=20 the Bush campaign probably came from the uninsured junk bonds Lincoln = sold to=20 between 17,000 and 23,000 people in southern California, defrauding them = of in=20 excess of $250 million dollars. I personally believe the actual amount = of the=20 fraud was tens of millions of dollars higher given the fact that there = were no=20 less than six bond issues from October 10th, 1988 to an unspecified date = in=20 January 1989, amounting to some $240 million dollars for this period = alone.=20 (Trust Me, pp. 340-345). However, Lincoln was selling = these junk=20 bonds as early as January 1988. The actual dollars that were skimmed = probably=20 came from the junk bond sales of July, August and September 1988; it is = also=20 probable these monies were paid to Keating, members of his family, and = to ACC=20 and Lincoln executives as bonuses or salaries, with the proviso that = some=20 portion thereof be skimmed off for the Bush campaign.

Investigative Leads=20 -- Where to look for the "smoking gun." = One way=20 to determine if this occurred or not is to subpoena the checks and other = documents from the Bush campaign or the Republican National Committee = and to=20 track these records back to the individuals who wrote the checks. This = is easier=20 said than done. After being burned during the Watergate investigations = by the=20 revelations of Herbert Kalmbach, there is every reason to believe the = Republican=20 Party developed a number of techniques to conceal the actual money trail = in=20 1988. Whoever investigates this should look back at the 1985 and 1986 = bundling=20 of campaign money by Keating and his associates to determine how they = did it=20 then and then look for the same pattern in the 1988 skimming. In = addition,=20 Manning and his team were able to convince several ACC or Lincoln = executives to=20 turn states evidence in an effort to reduce their own criminal exposure. = These=20 people should be interviewed. Moreover, the 30,000 square foot archive = of ACC=20 and Lincoln documents still exists in Phoenix.

After reading of Michael Manning's difficulties in = constructing=20 a criminal case against Keating that would stand up in court, I can = understand=20 why a $100,000 campaign contribution could be lost in the paperwork of a = several=20 hundred million dollar fraud. However, Keating's $100,000 contribution = to the=20 Bush Campaign became public knowledge in early 1990 when the Republican = National=20 Committee released his name to Common Cause Magazine. = Someone in=20 one of the regulatory agencies should have asked for a separate = investigation at=20 that time focusing on this single point. No such investigation was = initiated in=20 1990 or in the four years since then.

The = Cover Up of a=20 Cover Up. Why has there been no = investigation?=20 After the Reagan-Bush White House, Senator Jake Garn, and U.S. League of = Savings=20 Institutions made M. Danny Wall the new Chairman of the Federal Home = Loan Bank=20 Board (FHLBB) on July 1, 1987, they had a man in place who would contain = a=20 growing political problem until after the presidential elections of = 1988. This=20 is best described on pp. 238 and 239 of Overdrawn: The Bailout of = American=20 Savings by Michael A. Robinson:

After Wall joined the Bank Board, Keating's = institution was=20 allowed to remain open for an extra two years beyond the time that Jim = Cirona=20 and his staff wanted to take action. Indeed, the Bank Board transferred=20 supervision of Lincoln Savings away from Cirona in San Francisco, in a = move that=20 stunned regulators throughout the country. Delays in closing Lincoln = increased=20 the eventual cost to the taxpayers, a price tag that approached $2 = billion, and=20 allowed Keating to sell worthless bonds to unsuspecting customers who = thought=20 they were getting federally insured accounts.

Wall's handling of Lincoln was not his only, and may = not have=20 even been his most serious, mistake. Whereas [Edwin] Gray constantly = warned of=20 an eventual taxpayer bailout, Wall consistently downplayed the scope of = the=20 industry's mounting losses. His gross miscalculations eventually had him = at odds=20 with his fellow board members, who were predicting much higher cleanup=20 bills.

In addition, Washington insiders accused Wall, who = was becoming=20 a scapegoat for years of problem S&Ls, of intentionally misleading = Congress=20 and the American public about the size of the impending disaster until = after the=20 1988 presidential elections, presumably to help George Bush's election=20 efforts.

I believe that an investigation into the Keating = contribution=20 to the Bush Campaign, even after Bush had been elected President, would = have=20 revealed that Keating had skimmed these contributions from the uninsured = junk=20 bond sales of 1988. [Can you see the headlines?] This would have opened = up the=20 role of Wall and the members of his senior regulatory staff in = Washington (and=20 the White House?) in protecting Keating for two years after the San = Francisco=20 FHLBB had recommended the S&L be seized. [Can you see the = headlines?] This=20 in turn would have exposed the coverup of the true extent of the Savings = and=20 Loan Debacle until after the 1988 election and would have jeopardized = Republican=20 political chances in 1990 and 1992. [Can you see the headlines?]

But it is now 1994 and the coverup of the coverup has = succeeded. There is a media feeding frenzy on Whitewater and Madison = Guaranty.=20 Tax returns and financial papers are examined in minute detail. All=20 interpretations are negative. There are implications of massive = improprieties=20 and the Clintons are tried and convicted in the press on a daily = basis.

What = Really Went=20 On. The true cost of Lincoln Savings = and Loan to=20 the American people is about $2.3 billion dollars. About $2 billion of = this was=20 or is in the federally-insured losses for which all of us will be paying = over=20 the forseeable future. The remaining $250 to $300 million dollars came = from the=20 life savings of about 20,000 people in Southern California who were = stripped of=20 their money by a con man who was under the protection of powerful = politicians.=20 The Keating Five senators took the major hit for protecting Keating, but = their=20 role in this after being informed of the 1987 criminal referral was = relatively=20 minor (go back and read the record of the things they actually did for = Keating=20 after this time.) Cranston, the most culpable of the Keating Five, left = office=20 in disgrace in 1992.

But = who had the=20 power to protect Keating after the = criminal=20 referral of April 9th, 1987? One of the clues to this is a note from = Keating to=20 Alan Cranston just eight days before Keating took ACC into Chapter 11 = bankruptcy=20 on April 13, 1989. Lincoln had lost $29 million dollars in the first = three=20 months of 1989 and Keating had been making frantic attempts to put = together a=20 deal to sell Lincoln and thus avoid a federal takeover. In the note, = Keating=20 says

"some politically important person [Cranston] has got = to lay it=20 on the line to Danny Wall and Jake Garn that they unescapably and must=20 decisively approve this deal. [sic] They must do it in such a way that = the=20 forcefulness cannot be misunderstood." (Trust Me, p.=20 349)

Cranston, a member of the majority Democratic = leadership in the=20 Senate was the messenger; Wall and Garn, a member of the Republican = minority in=20 the Senate, represented the actual power. In=20 Overdrawn, Michael Robinson provides a highly informative = account=20 of Wall (and Garn) before Wall was appointed chairman of the FHLBB on = July 1st,=20 1987:

His thirteen-year employment for the conservative = Republican=20 senator taught Wall the inner workings of Washington that few regulators = had=20 ever witnessed firsthand. Many banking regulators were career = bureaucrats or=20 were rotating through the government on their way to better-paying = jobs

As a key Garn staff member, Wall helped shaped [sic] = the=20 landmark Garn-St. Germain legislation deregulating financial services = which many=20 blamed for the current crisis that Danny Wall would now have to=20 resolve.

This account tells us two important things: First, = that some of=20 the people in the regulatory agencies (read political appointees) were = merely=20 rotating through the regulatory agencies to higher-paid jobs. Second, = and much=20 more important, that much of the legislation de-regulating the Savings = and Loan=20 Industry President Reagan signed into law in 1982 was written in Jake = Garn's=20 office at a time when the Republicans had the Presidency, majority = control in=20 the Senate, and a working majority (with conservative Democrats) in the = House.=20 (Look at the key votes in both the House and the Senate in the early = Reagan=20 years.)

The = Role of the=20 Media in a Democracy. As a responsible = newspaper,=20 the Mercury News has an obligation to its readers to = editorially=20 ask the S&L regulatory agencies to investigate the 1988 skimming of = money=20 for the Bush Campaign If this does not occur, then the Mercury = News=20 should begin to ask some very pointed questions. If, for = whatever reason=20 the agencies decide not to investigate the skimming, there is nothing to = stop=20 you from assigning reporters to contact the ACC or Lincoln executives = mentioned=20 above to ask how the money was bundled to the Bush = Campaign.

The "Whitewater" Standard

The Mercury News, the = Knight-Ridder chain,=20 and the other parts of the national media have to realize that a new = standard of=20 investigative reporting -- the "Whitewater Standard" -- has been = established in=20 the last three months. There is no going back. But this standard must be = applied=20 with equal vigor to all of the stories about the Savings and Loan = Debacle, and=20 not just to those about Clinton and his wife. If money was skimmed from = Madison=20 Guaranty to Clinton's campaign for governor of Arkansas in 1984, this = was a=20 crime. If money was skimmed from Lincoln Savings and Loan for the Bush = campaign=20 in 1988, this was a crime of the same magnitude.

But if the "Whitewater Standard" is not applied to = both stories=20 with equal force, then surely we are lost. This goes far beyond = politics. The=20 role of the media in a democracy is to inform; to provide the citizens = in that=20 democracy with a fair and unbiased presentation of the news so that = those=20 citizens can make informed decisions. Your coverage of Whitewater, and = the=20 coverage of the national media to date leads me to ask if this has now = changed.=20 You have a responsibility to answer the question: Is it the role of the = media to=20 inform or to indoctrinate? If you come down on the side of = indoctrination, then=20 the United States is no longer a democracy.
