Weinberg's Legacy
The = unassailable $2=20 billion Weinberg Foundation now wants $75 million = of taxpayer=20 money.

A group=20 of high-powered investors and developers marched into the = governor=92s=20 office Monday, May 13, to press their case for $75 million in=20 special-interest tax breaks for the Ko Olina resort. Two of the = men in the=20 group went unidentified in news accounts of the=20 meeting.
     The two were representatives = of the=20 deal=92s landowner: the Harry & Jeanette Weinberg Foundation, = best known=20 for its extensive program of charitable grants in Hawai=91i and = across the=20 Mainland. It might seem unusual for one of the nation=92s largest = charitable=20 foundations to be pleading with the Aloha State=92s governor for = big tax=20 breaks for resort development, but the Weinberg Foundation also = happens to=20 be a major Hawai=91i landowner with an increasingly active = interest in=20 development.
     The foundation operates = in a=20 milieu of big money, few rules, insider dealings and little public = information =97 a potentially dangerous mix of philanthropy and = deal-making,=20 all within the protective cover of its generous charitable=20 program.
     The tax-credit plan, which = would=20 finance an aquarium and science center and, in theory, deliver the = investors for new hotel and time-share projects at the sprawling = resort,=20 is being attacked by critics (reportedly including the state = Department of=20 Taxation and the Tax Foundation of Hawai=91i) as a dangerously=20 precedent-setting bailout for Ko Olina master developer Jeff Stone = and his=20 partners, who took control of the property in 1998. Cayetano has = stated=20 that he is considering a veto of the measure. He has until June 24 = to=20 decide.
     For the record, the Weinberg=20 Foundation=92s two representatives at the Cayetano meeting = included=20 foundation president Bernard Siegel, who traveled to Honolulu from = the=20 foundation=92s main office in Baltimore, and board vice president = Alvin=20 Awaya, who directs the foundation=92s activities in Hawai=91i from = an office=20 in Kaimuk=EF. Last year, the foundation purchased significant but=20 undisclosed acreage at Ko Olina on which the aquarium =97 as well = as other=20 projects =97 is proposed to be built.
     = Foundation=20 officials could not be reached for comment regarding the meeting, = but=20 Sheila Donnelly, whose public relations firm represents the Ko = Olina=20 resort, called their presence "a serious=20 thing.
     "It shows the Weinberg = Foundation is=20 very much involved as the landowner and as a financier," Donnelly = said.=20 "They are partners in the resort."
     = Charity for=20 the poor and developments for the wealthy at first glance appear = an=20 unlikely combination, but the Harry & Jeanette Weinberg = Foundation is=20 as unconventional as the maverick businessman who left his wealth, = and his=20 name, to benefit the poor =97 and perhaps to gall his enemies =97 = in=20 perpetuity.

In the works
     = The bid=20 for Ko Olina tax credits is not the first controversial proposal = to=20 involve Weinberg lands. On Maui, a planned theme park called Maui = Nui on=20 29 acres of prime Weinberg land at the entrance to K=EFhei was to = include an=20 aquarium and marine-research facility strikingly similar to that = proposed=20 for Ko Olina. Animal-rights activists have attacked the Maui plan = because=20 it envisions research and public displays of captive dolphins, = which, they=20 claim, are simply a thin marketing veneer for an otherwise mundane = tourist=20 trap. Vocal opposition to the exhibition of dolphins has stalled = the=20 otherwise fully permitted project, which remains in=20 limbo.
     Two years ago, Weinberg = purchased a=20 large parcel including the Luana Hills golf course on the slopes = of=20 Olomana in Maunawili. The $12-million purchase has area residents = wary.=20 Formerly known as the Royal Hawaiian Country Club, the golf course = nestles=20 into some of the Windward Side=92s most scenic and desirable=20 land.
     The foundation has opposed city = efforts=20 to purchase part of the property for future park use. Weinberg = officials=20 have been mum about their own long-term plans for the area and = have=20 declined to meet with representatives of the Maunawili Community=20 Association, according to Donna Wong of Hawai=91i=92s Thousand = Friends.=20
     Back in Maryland, the Weinberg = Foundation=20 took the lead in presenting a plan for redevelopment of its = rundown=20 section of Baltimore=92s west side several years ago. Although = stalled by=20 community concerns, the plan illustrates the kinds of problems = that can=20 emerge as the foundation moves to develop or redevelop properties = in its=20 real-estate portfolio.
     In a letter = published=20 in the Baltimore City Paper, attorney John C. Murphy described = writing to=20 the foundation on behalf of tenant Young Cho, operator of a small = beauty=20 parlor in a Weinberg-owned building the foundation planned to = demolish.=20
     Murphy, who represents several = tenants in=20 Weinberg-owned buildings in Baltimore, said it was Cho and other = small=20 business owners who moved in, made repairs and began providing=20 neighborhood services, despite Weinberg=92s failure to even slap a = coat of=20 paint on the buildings.
     But = Weinberg=92s=20 development plan, which envisioned demolishing hundreds of = buildings in=20 order to make way for gentrification and the development of = high-priced=20 housing and a slew of national retailers, had no room for the = small=20 businesses that had survived the neighborhood blight =97 blight = that had=20 been created by the foundation=92s tight-fisted investment = approach.=20

A legacy of controversy
     = Henry=20 Weinberg, who died in 1990 at age 83 and left a fortune reportedly = worth=20 $900 million, was a Baltimore transplant who is perhaps best = remembered in=20 Honolulu as the "streetcar man" who grabbed control of Honolulu = Rapid=20 Transit Company, or HRT, the privately owned precursor to = Honolulu=92s=20 TheBus system. (Wife Jeanette Weinberg passed away in 1989 at age=20 79.)
     Taking over through a proxy = battle around=20 the time of Hawai=91i statehood, Weinberg repeated the game plan = he had=20 pulled off in Dallas, Texas, and Scranton, Pennsylvania. After = taking=20 control of the transit system, he plunged into a series of battles = with=20 the Teamsters, the Public Utilities Commission and the city, = eventually=20 forcing the government to buy him out and take over the system = after a=20 long bus strike in 1971.
     Weinberg took = the=20 same tactics to corporate boardrooms as one of the original = corporate=20 raiders, buying blocks of a company=92s stock and then creating = such=20 disruptions that the company would gladly buy him out at a=20 profit.
     He joined forces with a Los = Angeles=20 investor in the mid-1960s to take seats on Amfac=92s board of = directors,=20 triggering a bitter battle for control and another profitable = buyout, a=20 game plan played out with some variations at Maui Land & Pine = and=20 Alexander & Baldwin.
     Throughout = his=20 career, Weinberg also invested in distressed real estate in = Hawai=91i and=20 Baltimore. A self-described long-term investor, he bought = commercial=20 property when prices were low and held on. =
    =20 "Weinberg had sort of a notorious reputation for being this guy = who would=20 never put a penny into his properties," attorney Murphy said in a=20 telephone interview.
     "He let them sit = and=20 would rent them for whatever he could rent them for," Murphy said. = "People=20 thought it was almost bizarre, not the conduct of a typical = landlord, who=20 would at least make minimal = improvements."
     In=20 Baltimore, where Weinberg gradually bought up several blocks on = the west=20 side of the city, former Mayor William D. Schaeffer "pleaded with = Weinberg=20 to sell his properties so they could be rehabbed, but he never = would=20 sell," Murphy said.
     In Hawai=91i, = Weinberg=20 continued his pattern of buying and holding commercial real = estate. As a=20 result, the Weinberg Foundation is now the third-largest private = landowner=20 in the state measured by total assessed values, according to a = study=20 published last year by Hawaii Business magazine. Only Kamehameha = Schools=20 and the Queen Emma Foundation own property with greater overall=20 value.
     Much of the foundation=92s land = is held=20 by a series of companies it controls directly or indirectly, = including HRT=20 Ltd., Honolulu Limited, 3900 Corporation, Gutman Realty Company = and 300=20 Corporation.
     The Weinberg = Foundation=92s=20 holdings include central Hilo=92s decrepit Kaiko=91o Mall, which = is being=20 purchased by the state Judiciary for a new court complex; the = Lahaina=20 Shopping Center on Maui, several properties in downtown = L=EFhu=91e, Kaua=91i;=20 and properties in different parts of O=91ahu, from the Hau=91ula = Shopping=20 Center to several parcels around the M=E4kaha Valley=20 Resort.
     In addition to the Ko Olina = land and=20 Luana Hills golf course, the foundation purchased the Willows = Restaurant=20 site in M=F6=91ili=91ili in 1998, and revived the restaurant as a = monument to a=20 previous era of casual island living.

Rewriting=20 history
     "They=92ve had more impact = locally=20 in the past 10 years than any other foundation," said the Rev. = Frank=20 Chong, executive director of the Waik=EFk=EF Health Center, a = recipient of=20 several Weinberg grants.
     In the 12 = years since=20 Weinberg=92s death, the foundation=92s assets have grown to more = than $2=20 billion, according to last year=92s 704-page tax return. The = Weinberg=20 Foundation ranks among the 25 largest private foundations in the = country,=20 both in terms of assets and grants given annually.=20
     It has gotten the attention of local=20 community leaders and activists alike by awarding an average of = nearly $15=20 million in grants to organizations in Hawai=91i every year for the = last=20 decade. This makes up about 15-20 percent of the foundation=92s = total annual=20 giving, tax records show.
     Chong = credits the=20 Weinberg Foundation for investing heavily in organizations = providing=20 health and social services to the poor and elderly during the very = tough=20 economic conditions of the last several = years.
    =20 Before he died, Weinberg restricted the foundation=92s scope of = giving. A=20 portion of its funds goes to support Jewish charities, and the = rest go to=20 organizations benefiting the poor and underserved. Weinberg = directed that=20 no money be given to causes favored by the upper class, such as = the=20 symphony, art galleries, museums or colleges and universities.=20
     Unlike most foundations, Weinberg = gives large=20 grants for construction, some of them valued at upwards of $1 = million,=20 according to Kelvin Taketa, executive director of the Hawai=91i = Community=20 Foundation.
     "A lot of health and human = service=20 organizations can get contracts from the government to provide = services,=20 but government isn=92t going to pay them to build the building = they operate=20 in," Taketa said. "It=92s a terrific = marriage."
    =20 Honolulu is peppered with buildings bearing the "Harry & = Jeanette=20 Weinberg Foundation" name. This ubiquity is driven by a foundation = policy=20 that requires any organization receiving more than $250,000 for a = building=20 fund to agree to name the building after the foundation.=20
     A visitor driving around the island = might=20 pass a Weinberg YMCA building, a Weinberg Boys & Girls Clubs = service=20 center, a Weinberg cancer center, several Weinberg elderly housing = projects =97 more than 80 buildings reportedly carry the=20 name.
     This has meant a virtual = rewriting of=20 history, one nonprofit administrator said. Like John D. = Rockefeller,=20 Andrew Carnegie, J.P. Morgan and the other robber barons of the = 19th=20 century, Weinberg was considered a ruthless businessman in life, = but he=20 then created a halo for himself that transformed his legacy.=20
     "Local businessmen hated Harry = Weinberg,"=20 Chong said. "But after he died, and it was clear where his money = was=20 going, that seems to have changed, at least for most people. The = name=20 Weinberg is now associated with health and human services, = children and=20 the elderly. He=92s seen in a way that could never have been when = he was=20 alive."
     "I think it=92s a struggle for = some of=20 the old-time business types who had to deal with him," said=20 Chong.
     David Nakata, executive = director of=20 Boys and Girls Clubs of Hawai=91i, puts it bluntly: "I think for a = lot of=20 the nonprofit folks out there, we pretty much love him because he = did so=20 much to help us out," Nakata said. "Without the Weinberg=92s help, = we=20 couldn=92t have done what we did."
     But = like the=20 hard-nosed, unpredictable and contentious Weinberg, the foundation = that=20 bears his name plays by no rules except its own.

Not = your=20 parents=92 foundation
     In the = foundation=20 world, the Weinberg Foundation is an aberration and somewhat of a = mystery.=20 Virtually all large foundations have a grants=92 calendar or = schedule,=20 application forms, published rules, submission deadlines, annual = reports=20 and all manner of bureaucracy, while Weinberg functions with just = common=20 sense and a handshake, according to several former grant=20 recipients.
     Sometimes virtually no = paperwork=20 changes hands, they report.
     "When you = get a=20 grant, an envelope arrives. It=92s just a check," Chong said. = "Other=20 foundations send contracts. They want receipts, progress reports, = and=20 continued written assurances of how it will or is being spent. But = I=92ve=20 never been asked for a report by Weinberg. They=92re willing to go = out on a=20 limb with you."
     And Weinberg is = flexible=20 enough to change its internal "rules" whenever they feel like it, = adapting=20 quickly to changing conditions and needs. =
    =20 Local groups see it as a breath of fresh air in the otherwise = well-meaning=20 but stodgy world of big-time philanthropy. The foundation is = considered=20 very easy to work with, and credit is widely given to their local = grants=20 coordinator, Gailene Wong.
     Wong works = with=20 agencies, screens potential projects and forwards recommendations = to the=20 foundation=92s trustees, a process which grant recipients say = works=20 smoothly.
     But in many other ways the=20 foundation has inherited Harry Weinberg=92s style, especially in = its=20 business dealings rather than its charitable activities. By all = accounts,=20 Weinberg went further than most donors in attempting to control = the future=20 course of his foundation by restricting its activities, limiting = the=20 causes it can support, leaving control in the hands of trusted = insiders,=20 even naming replacement trustees in advance who will take over = from the=20 original five.
     One distinctive = characteristic=20 is the foundation=92s penchant for secrecy. While most foundations = promote=20 their own public image, its officials rarely give interviews or = publicly=20 discuss foundation affairs.
     "They=92ve = relied on=20 the same old gang that was running Weinberg=92s business = interests," says=20 attorney Murphy. "They don=92t fit the foundation mold, and seem = to be the=20 old business people, only doing this."
     = Awaya,=20 the trustee in charge of the foundation activities in Hawai=91i, = was=20 Weinberg=92s accountant for two decades. Siegel, the = foundation=92s president,=20 was Weinberg=92s accountant in Baltimore. Honolulu attorney Reuben = Wong=20 represented Weinberg and continues to handle affairs of the=20 foundation.
     Tom Enomoto, a local = developer and=20 behind-the-scenes power broker in the administration of former = Gov. John=20 Waihe=91e, leased a number of properties from Weinberg, managed = others and=20 continues as a consultant to the foundation. =
    =20 Some observers are perplexed by Weinberg=92s apparent = contradictions. They=20 note that while gleaming new buildings go up bearing the Weinberg = name,=20 the foundation=92s existing properties continue to languish, with = minimal=20 care.
     The Weinberg-owned Hau=91ula = Shopping=20 Center on Windward O=91ahu, for example, is rundown in appearance, = and some=20 are concerned about its structural integrity after portions of the = roof in=20 one section collapsed several years = ago.
     "We=92d=20 all like the shopping center to be a source of pride for the = community,=20 but it is an embarrassment," one community leader=20 commented.
     But community groups who = have or=20 hope to benefit at some point from the Weinberg Foundation=92s = largess are=20 unlikely to voice criticism due to a key foundation=20 guideline.
     According to documents = filed with=20 the IRS soon after Weinberg=92s death: "If any charitable = organization at=20 any time challenges, directly or indirectly, (1) the manner in = which the=20 Trustees exercise their discretion on any subject, ..." [or = challenges the=20 will or any contract] =85"such charitable organization shall = forever be=20 barred from receiving any distributions from the=20 Corporation."
     It isn=92t known whether = any=20 groups have actually been cut for speaking critically, but few = want to=20 test the situation. This limiting of potential criticism could = become=20 increasingly significant as the foundation and its affiliates gear = up to=20 develop their properties and, in the process, increase their = impacts on=20 surrounding neighborhoods.
     In the = absence of=20 public scrutiny, criticism and ongoing accountability, the = business=20 dealings of large charitable institutions are a fertile ground for = abuse,=20 as the Kamehameha Schools=92 (formerly Bishop Estate) "broken = trust" scandal=20 so painfully demonstrated.
     With the = keen=20 public interest in avoiding such abuses, close and careful public = scrutiny=20 of its operations should not in any way diminish the unusual = legacy of the=20 Harry & Jeanette Weinberg Foundation=92s extensive and life = saving=20 charity.
